Overview
Amundsen Davis received a dismissal on behalf of a client involved in a motor vehicle accident. We conducted an investigation of the plaintiff which revealed that the plaintiff had not listed the lawsuit in her bankruptcy schedules and had made no attempt to amend those schedules. The motion to dismiss was granted based on her lack of standing to bring the lawsuit, and the plaintiff was judicially estopped from presenting herself in opposite positions in circuit court and federal bankruptcy court.
