Obtained a Dismissal in Asbestos Case and Avoided Costly Discovery

Overview

The plaintiff was an installer who claimed that he developed mesothelioma due to exposures to asbestos at various locations in the Chicago area.  We obtained a dismissal of our premises defendant, Motorola (one of five left in the case) after the cross-examination of the plaintiff during his trial testimony (taken at his evidence deposition).  Dismissal of Motorola at that juncture avoided our having to engage in expensive fact and expert discovery or having to brief motions for summary judgment and motions in limine.
