Overview
Moses Suarez obtained a favorable defense settlement for hospital client in a catastrophic birth injury case in federal court involving OBGYN physicians employed by a Federally Qualified Health Center (FQHC). The plaintiffs alleged the OBGYNs failed to oversee the labor, apply appropriate fetal monitors, and timely order a c-section. The evidence demonstrated nurses followed hospital policy for fetal monitoring. When negotiations ensued, Moses successfully resolved the case for the hospital to pay only 25% of the settlement.
