Obtained Dismissal of FDCPA Claims at Outset of Litigation

Overview

Amundsen Davis obtained dismissal of FDCPA claims on a motion to dismiss in a putative class action lawsuit.  The Court accepted Amundsen Davis’s argument that one defendant was not a “debt collector” as defined by the FDPCA, and the co-defendant was likewise not liable because it was the agent of the defendant. After obtaining dismissal of FDCPA claims, the plaintiffs dismissed their remaining class action allegations, and the case resolved on an individual basis.
