Obtained Dismissal of Putative Class Action Lawsuit Alleging Improper Collection Tactics

Overview

Our client, a large, Chicago-based property management company, faced a class action lawsuit in federal court based on the collection activities of a third-party vendor.  Prior to answering the Complaint, Amundsen Davis conducted a thorough investigation of the claims which revealed significant weaknesses in the plaintiff’s case. Amundsen Davis then brought a motion to dismiss the complaint based on that investigation. Rather than respond to the motion, the plaintiff amended her complaint and dropped Amundsen Davis’s client as a defendant from the lawsuit.
