Amundsen Davis represented the developer of a golf course community who wished to develop an open parcel into another single family residence in the golf course community. After the municipality denied the developer’s request to rezone the parcel it wished to develop, Amundsen Davis obtained a trial verdict in favor of the developer and against municipality, finding that the municipality had acted in an arbitrary and capricious manner when denying the developer’s request to rezone the lot, which was being used as green space in the golf course community, for residential use.
