Amundsen Davis prevailed in a declaratory judgment action on behalf of an insurer on two issues. First, the court granted summary judgment to Amundsen Davis’s client on the issue of whether an exclusion in a professional liability policy applied to bar coverage where an insured knew, or could have reasonably foreseen, that his representation of a client prior to the effective date of the policy could give rise to a lawsuit against him. Second, the court held that coverage under several policies was barred because the claim was not made and reported during any of the prior policy periods.
