Overview

Amundsen Davis successfully invoked the Terms and Conditions agreed to by customers of a major nonprofit organization to stay discrimination litigation pending arbitration, even though most of the customers were minors when they agreed to the Terms and Conditions. The Court found that customers who were still minors could repudiate their contract under California law but enforced the Terms and Conditions as to those customers who had since reached the age of majority.
