Won a Motion to Dismiss on a Construction Contract Case Involving Enforceability of a Forum Selection Clause and Public Policy

Matt McClean won a motion to dismiss on a construction contract case in the District Court of Kansas brought by a general contractor. The issue involved the enforceability of a forum selection clause and Kansas public policy, where the contract not only called for suit to be brought before the Court of the Grand Duchy of Luxembourg, but also where CTI had already obtained a default judgment. The court concluded Luxembourg was the proper forum.
