Amundsen Davis won partial summary judgment on complex issues of federal preemption with respect to the alleged negligent conduct of the client, a federal railroad operator. Summary judgment was granted on issues of the design and construction of a railroad traffic crossing, which was the site of the accident that caused the death of the plaintiff’s decedent. After allegations regarding the construction and layout of the crossing were dismissed pursuant to federal regulations, the case settled favorably on the remaining counts.
