Amundsen Davis Associate Isabelle Faust won summary judgment in a negligence case representing a trucking company and its driver after they were involved in a 60+ car pileup. The plaintiff alleged that the truck helped create a "black wall" of disabled vehicles during a snow storm in Eau Claire County, Wisconsin, causing him to crash and sustain severe injuries. Isabelle argued that the plaintiff's claims should be dismissed because: 1) there was no evidence of a causal connection between the client's actions and the plaintiff's damages; 2) public policy considerations should not permit recovery; and 3) the emergency doctrine barred the claims. Summary judgment was grated before the driver was even deposed.
